Voting FOR or AGAINST?
Body

As registered voters prepare for the Tuesday, Nov. 3, general election, they will be asked to decide more than which candidates should hold public office. Four statewide proposals will also appear on the ballot, addressing online sports wagering, school athletics and term limits for state senators.

According to the Nebraska Secretary of State's Office, three proposals were placed on the ballot through the initiative petition process, while a fourth was referred to voters by the Nebraska Legislature.

For voters unfamiliar with the legal language used in ballot questions, understanding what a vote FOR or AGAINST would accomplish can be confusing.

The following explanations break down each proposal in everyday language.

Initiative Measure 440 — Online Sports Wagering Authorization What does it mean? This measure asks whether Nebraska's Constitution should be changed to allow the state to authorize sports betting through websites and mobile applications.

Currently, Nebraska allows sports wagering at authorized casino locations, but the proposal would open the door to placing bets online while physically located anywhere within the state.

Voting FOR means: You support changing Nebraska's Constitution to permit laws authorizing online sports wagering through licensed gaming operators. This measure provides constitutional authorization; it does not, by itself, establish all the rules for online betting.

Voting AGAINST means: You do not support making that constitutional change. The existing constitutional restrictions would remain, and this measure would not authorize online sports wagering.

Initiative Measure 441 — Online Sports Wagering Regulation While Measure 440 addresses whether online sports wagering can be constitutionally authorized, Measure 441 addresses how it would operate. These can be confusing if you do not understand the difference.

This proposal would establish laws allowing authorized Nebraska gaming operators, or their approved platform providers, to offer online sports wagering to people physically located within Nebraska.

It would also establish regulatory requirements under the Nebraska Racing and Gaming Commission, including rules for online wagering platforms.

Voting FOR means: You support enacting the proposed laws to permit and regulate online sports wagering through authorized operators.

Voting AGAINST means: You do not support enacting those laws. The proposed online sports wagering system and regulations would not be established through this measure.

Important distinction: The Courier would explain that 440 is the 'permission' and 441 as the rulebook. Measures 440 and 441 are separate questions, but they are closely connected. Measure 440 addresses constitutional authorization, while Measure 441 establishes the proposed operating rules. Approval of Measure 441 alone would not remove any constitutional restrictions that remain in place.

Initiative Measure 442 — Fairness for Girls This measure proposes adding language to the Nebraska Constitution concerning participation in school athletics.

The proposal would require covered schools to designate athletic teams and sports according to biological sex as boys' or men's teams, girls' or women's teams, or coed teams.

It would also prohibit students classified as male under the proposed constitutional language from participating on teams designated for girls or women.

The measure would apply to public schools and public colleges and universities, as well as private educational institutions whose teams compete against public institutions.

Voting FOR means: You support adding these requirements and restrictions to the Nebraska Constitution.

Voting AGAINST means: You do not support adding these provisions to the Nebraska Constitution. Existing laws and athletic participation rules would not be changed by this proposal.

Supporters argue the amendment would protect fairness, safety and athletic opportunities for female students.

Opponents argue it would unnecessarily restrict participation, particularly for transgender students, and raise privacy concerns.

Constitutional Amendment LR19CA — Legislative Term Limits Nebraska currently limits state senators to two consecutive four-year terms, or eight consecutive years, before they must leave the Legislature for at least four years.

This proposed constitutional amendment would increase that limit to three consecutive four-year terms, allowing senators to serve up to 12 consecutive years before the required break.

Unlike the other three measures, this proposal was placed on the ballot by the Nebraska Legislature rather than through a citizen petition.

Voting FOR means: You support allowing Nebraska state senators to serve three consecutive four-year terms instead of two.

Voting AGAINST means: You support keeping the existing limit of two consecutive four-year terms.

The proposal would not eliminate legislative term limits. It would extend the number of consecutive terms a senator may serve.

Understanding ballot measures allow Nebraska voters to make decisions directly about proposed changes to state laws and the Nebraska Constitution.

The Nebraska Secretary of State's Office has published an informational pamphlet containing the ballot language, full text and arguments from supporters and opponents of the three initiative measures.

The Callaway Courier has used that pamphlet to help explain these measures.

Voters are encouraged to review the questions before Election Day so they understand what each choice would mean when they cast their ballots on Nov. 3.

A sample ballot for these Measures is on PAGES 15-17 of this paper.
